If you don’t have the money to ensure you could outbid others for the house (it will be an auction) at the tax sale, then pay the taxes to stay as long as you can. Meantime, find an investor who will buy the house from the bank and let you rent it, preferably with an option to own.

If you have other assets such as saving and you are not insolvent, you may end up being responsible to pay ordinary taxes on the amount of the 1099-C.

If you settle a debt with a creditor for less than the full amount owed, you may be required to report this forgiven debt as regular income, with certain important exceptions. The forgiven debts include money owed after foreclosure or property repossession or credit accounts that you don’t pay. There are exceptions noted below.

If a lender forgives or writes off $600 or more of a debt’s principal (the amount not including interest or fees) must send you and the IRS a Form 1099-C at the end of the year. When you file your tax return for the tax year in which your debt was written off, the IRS will require that you report the amount on the form as income.

While you may not have received this form from the creditor, the creditor may have submitted one to the IRS anyway. If you don’t list the income on your tax return and the IRS has the information of the transaction on file, you could get a tax bill or, worse, an audit notice. This could end up costing you more than just the original tax bill.

There are several exceptions stated in the Internal Revenue Code. For example, you do not have to report the income on your tax return if the write off of the debt is intended as a gift, you discharge the debt in bankruptcy, or you were insolvent before the creditor agreed to settle or write off the debt. You should consult a qualified tax and legal counsel to see if these circumstances apply.

An experienced, professional real estate agent or counselors certified by the Department of Housing and Urban Development (HUD) can help you explore available options, says Care , including:

Forbearance. A forbearance is a temporary suspension of payments sometimes offered if a borrower has lost a job but has a new one starting soon — or because medical bills or another crisis situation has caused a temporary cash shortage.

Repayment plan. Repayment plans offer a scheduled blueprint for making up missed payments over time.

Loan modification. A loan modification is a change in loan terms for a limited time, as when a subprime interest rate has jumped considerably.

Care also advises financially distressed homeowners to be extremely wary of anyone purporting to offer a “quick-fix” solution. According to the Federal Trade Commission, steer clear of anyone who:

Guarantees to stop the foreclosure process
Collects upfront fees
Asks to be paid by wire or cashier’s check
Tells you not to contact your lender or lawyer
Wants you to make mortgage payments directly to him/her
Suggests you sign over or “share” your property deed or title
Proposes a lease-and-buyback arrangement
Offers to fill out paperwork for you
Pressures you to sign documents you do not fully understand
“Unfortunately, there is a growing contingent of foreclosure scam artists preying on vulnerable homeowners,” says Care . “Financially distressed homeowners should consult a real estate professional who can point them in the right direction and offer sound guidance on the potential options that can save their home from foreclosure.”
